Welcome to A Sunday Project (“A Sunday Project,” “we,” “us,” or “our”). These Terms of Service (“Terms”) are a legally binding agreement that governs your use of our website, content, and related services (collectively, the “Services”). 

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately discontinue use of the Services. 

 

  1. Eligibility and Use of Services

You may use the Services only if you are at least 18 years old and capable of entering into legally binding agreements. You agree not to: 

  • Use the Services in violation of any applicable law or regulation 
  • Interfere with the operation, security, or integrity of the Services 
  • Attempt to gain unauthorized access to our systems, data, or user accounts 
  • Use automated tools (such as bots or scrapers) without our prior written consent 

 

  1. Accounts and Security

If the Services require account creation, you must provide accurate and complete information and keep your login credentials secure. You are solely responsible for all activity under your account. You agree to notify us immediately of any unauthorized use of your account. 

 

  1. Purchases and Payments

When making a purchase, you authorize us (or our third-party payment processor) to charge your designated payment method. All payments are final and non-refundable unless otherwise required by law. 

 

  1. Intellectual Property

All content, trademarks, graphics, and other materials available through the Services are the exclusive property of A Sunday Project or its licensors. You are granted a limited, non-transferable, revocable license to use the Services for personal, non-commercial purposes. Any unauthorized use may result in termination of your access. 

 

  1. Third-Party Links and Services

Our Services may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or actions of third parties. Accessing third-party sites is at your own risk. 

 

  1. Disclaimer of Warranties

To the fullest extent permitted by law: 

  • The Services are provided “as is” and “as available” without warranties of any kind, express or implied. 
  • We disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, title, and non-infringement. 
  • We do not warrant that the Services will be secure, uninterrupted, error-free, or free of viruses. 

 

  1. Limitation of Liability

To the maximum extent permitted by law: 

  • A Sunday Project and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, data, or goodwill. 
  • Our total liability to you for any claim arising out of or related to the Services shall not exceed the greater of (i) $100 or (ii) the total amount you paid to us in the 12 months preceding the claim. 

Some jurisdictions do not allow certain limitations, so these may not apply to you. 

 

  1. Indemnification

You agree to indemnify, defend, and hold harmless A Sunday Project, its affiliates, and their respective officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to: 

  • Your use of the Services 
  • Your violation of these Terms 
  • Your infringement of any third-party rights 

 

  1. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles. Subject to the Arbitration Agreement below, any disputes shall be resolved exclusively in the state or federal courts located in Michigan. 

 

  1. Arbitration Agreement & Class Action Waiver
  2. Agreement to Arbitrate
    Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding arbitration under the rules of the American Arbitration Association (AAA). The arbitration will be conducted in Kent County, Michigan.
  3. Class Action Waiver
    You agree that disputes will be resolved on an individual basis only. Neither you nor we may participate in a class, collective, or representative action.
  4. Small Claims Exception
    Either party may bring an individual action in small claims court in Kent County, Michigan, if eligible.
  5. Jury Trial Waiver
    By agreeing to arbitration, both parties waive the right to a jury trial.

 

  1. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms. Termination does not affect provisions that should reasonably survive, including intellectual property rights, indemnification, limitations of liability, and arbitration. 

 

  1. Changes to These Terms

We may update these Terms from time to time. Updates will be posted on our website with a revised “Effective Date.” Continued use of the Services after updates are posted constitutes acceptance of the new Terms.
